Auric Movement LLC ("we," "us," or "our") is committed to protecting your personal information in accordance with the New York SHIELD Act, the federal CAN-SPAM Act, and other applicable laws.
1. Information We Collect
We collect your full legal name and email address when you sign a liability waiver. If you provide an event name or event date, we collect those as well. We also record the date and time of your signed waiver. For certain events, we may ask you to disclose health information (see Section 2 below).
2. Health Information
For certain events, you may be asked to disclose health conditions (such as recent surgeries, injuries, pregnancy, chronic conditions, current medications, or other relevant medical information) so your instructor can ensure your safety during physical activity. This information is treated as confidential and is used solely by your instructor to provide safe and appropriate guidance. We do not share health information with any third parties. Health disclosure data will be permanently deleted within 30 days after the event concludes. By voluntarily disclosing health information, you consent to its limited use as described in this Policy. Auric Movement LLC is not a healthcare provider, and this information is not covered by HIPAA; however, we apply reasonable safeguards consistent with the New York SHIELD Act to protect it.
3. How We Use Your Information
Your information is used solely to: (a) maintain a record of signed liability waivers; (b) confirm receipt of your signed waiver; (c) contact you regarding the event you have signed up for, if applicable; and (d) allow your instructor to safely modify activity based on any health disclosures.
4. How Your Data Is Stored
Waiver records are stored via Supabase (a secure third-party database service) and transmitted via EmailJS to our inbox at auricmovement@outlook.com. Data is not transferred outside the United States. Waiver records, including health information, will be retained as required for legal and liability purposes and deleted thereafter upon request.
5. We Do Not Sell Your Data
We do not sell, rent, trade, or share your personal information — including health information — with any third parties for marketing purposes.
6. Cookies
This site uses essential cookies only for functionality (such as saving your progress through the waiver form). No tracking or advertising cookies are used.
7. Your Rights (NY SHIELD Act)
You have the right to request access to, correction of, or deletion of your personal information, including health disclosures. Email us at auricmovement@outlook.com. We will respond within 30 days.
8. Data Security
We implement reasonable administrative and technical safeguards consistent with the New York SHIELD Act, including encryption in transit, access controls, and limited retention periods.
9. Minors
This waiver is not directed at individuals under the age of 18 unless accompanied by a parent or legal guardian who signs on their behalf.
